R. Hermann Heimgartner has extensive experience in handling  divorce, custody, paternity, and TRO cases.

Mr. Heimgartner has been handling divorce cases since 2015.  Divorces fall within two categories:  contested or uncontested.

Uncontested divorces are where husband and wife agree on ALL aspects of the divorce, including child custody and property division.  Uncontested divorces basically require the preparation of the paperwork and submitting such paperwork to the court.  A complaint for divorce requires to be filed and, thereafter, the parties can submit the paperwork to get divorce without requiring to appear in court.  Mr. Heimgartner regularly gets retained to prepare the paperwork and guide people through this process.  By doing the paperwork correctly, an uncontested divorce can be an expedited matter.

Contested divorces are where husband and wife do NOT agree on all aspects of divorce.  In other words, husband and wife disagree on one or more of the following: legal custody; physical custody; visitation; child support; alimony; property division.

Contested divorces often require one or more of the following:

  • Filing of pre-decree motions, such as motions for custody, visitation, and/or child support
  • Formal discovery
  • Depositions
  • Mediation
  • Custody evaluations
  • Motions for Orders to Show Cause
  • Motions to Set Trial
  • Motions to Compel Discovery
  • Motions To Enforce Pre-Decree Orders and/or Decree


Mr. Heimgartner represents mothers and fathers that need to establish paternity and custody of children born out of wedlock.

TROs/Order For Protections

Mr. Heimgartner represents persons getting TROs against another party and defending persons against whom a TRO is sought.

Mr. Heimgartner has been very successful in getting TROs and Protective Orders for clients that have been threatened, harmed, and/or abused by another person.  These cases require expedited work to ensure that person becomes protected as soon as possible.

Mr. Heimgartner has also been very successful in defending against TROs.  He will take prompt action to defend a person against whom false allegations are made.

For TRO and Protective Order cases, Mr. Heimgartner will meet with a client on short notice (even on the weekend), interview witnesses, gather exhibits, and prepare for heated court hearings on short notice.

In the past, Mr. Heimgartner has been retained and conducted two TRO hearings with multiple witnesses in altogether less than one week.  The result was the dissolution of a TRO...a success outcome for a client against whom false allegations were leveled.
